Die Strafbarkeit einer "actio libera in causa" läßt sich nach Ansicht der Autorin damit nur dann begründen, wenn sich zeigen läßt, daß sie im gleichen Sinn wie eine "actio libera in se" einen Angriff auf eine Gefahr für ein Rechtsgut darstellt. Auch ein normtheoretischer Ansatz, der die actio libera in causa mit der Verletzung einer neben den Pflichten aus den primären Verhaltensgeboten bestehenden Obliegenheit zu erklären sucht, sieht sich bei der Herleitung der Obliegenheit, bei der Frage nach der Rechtsnatur der Obliegenheit und im Hinblick auf das Koinzidenzprinzip Schwierigkeiten gegenüber. Nach Ansicht der Autorin läßt sich das Problem nicht aus einer rein dogmatischen Perspektive heraus oder durch ein Anknüpfen am Schuldbegriff lösen. Er geht dabei von einem weiten Verständnis der "actio libera in causa" aus, wonach eine "actio libera in causa" jedes Verbrechenselement zum Bezugspunkt haben kann, dessen Vorliegen oder Fehlen durch den Täter herbeigeführt werden kann. Der Artikel befaßt sich mit den Grundlagen, auf die sich die Strafbarkeit einer "actio libera in causa" stützen läßt. Moreover, the article discusses the objective and subjective requirements relevant for evaluating how this personal defect was brought about. Decisive as to whether this similarity is given is the way in which the actor brought about his inability to be held responsible for the criminal act, namely how he caused his own personal defect. The author contends that punishing an "actio libera in causa" can only be justified if one can show that the actio libera in causa represents an attack on, and a danger for, a legally protected interest in the same sense as is represented by the "actio libera in se". These difficulties relate to deriving the condition precedent itself, to explaining the legal nature of the precedent and to satisfying the principle requiring temporal coincidence between voluntary conduct and prohibited harm. This type of approach attempts to explain the actio libera in causa by comparing it to the failure to fulfill a condition precedent for obeying a norm, whereby the condition precedent exists in addition to the duties entailed by the primary rules of conduct.
